Today, a growing number of intended parents are creating their families through surrogacy arrangements. This unique process of creating families requires that intended parents and their surrogate work together and agree on a number of issues that will arise during and after a surrogacy arrangement, such as medical expenses and insurance coverage, compensation, confidentiality, potential long-term issues, and each party’s role in establishing the legal parentage. To ensure that the surrogacy process is one that is both smooth and joyful, it is imperative for everyone involved to understand, at the outset, his or her rights and responsibilities under a surrogacy arrangement, and the protections afforded by the surrogacy contractual agreement and the parentage/adoption proceedings to follow.
